Gomez Fights Back as Jersey City Seeks to Dismiss Lawsuit

Jersey City, NJ – The City of Jersey City has filed a motion to dismiss the lawsuit brought by former mayoral aide Jonathan Gomez Noriega, arguing that his termination was justified and legal. The city claims Gomez, who alleges wrongful termination and political retaliation, held a confidential position that allowed for removal at will, and that his political support for his sister’s campaign conflicted with his job responsibilities.

In response, Gomez’s legal team filed an opposition brief, calling the city’s argument an attempt to avoid accountability. “Mr. Gomez was not a policymaker, and his termination was a blatant violation of his First Amendment rights,” said his attorney, Giancarlo Ghione of Sekas Law Group. “This was political retaliation, not a legitimate workplace decision.”

The city also argues that officials, including Mayor Steven Fulop and Press Secretary Kimberly Wallace-Scalcione, are protected by qualified immunity, shielding them from personal liability. Gomez’s attorneys counter that the firing was not a routine employment decision but a calculated political move, making the lawsuit valid.

The court will now decide whether the case moves forward or is dismissed.
