Please read these Terms of Use completely before using HudPost.com. This Agreement documents the legally binding terms and conditions attached to the use of HudPost.com, operated by HUDPOST LLC. By using or accessing the site in any way, you are agreeing to be bound by these Terms of Use and our Privacy Policy. You must be at least 13 years of age to use this website, and 18 years of age to make purchases, submit content, or engage in financial transactions.

1. Privacy Policy Integration Your use of HudPost.com is also governed by our Privacy Policy, which outlines how we collect, use, and share your personal data. By agreeing to these Terms, you also consent to our data practices as described in our Privacy Policy.

2. Shop, E-Commerce Purchases, and Refund Policy HUDPOST LLC operates an online shop using WooCommerce. By purchasing products or services from us, you agree to provide accurate payment and shipping information.

  • Digital Services and Advertisements: All sales for digital products, missing pet flyers, advertising placements, sponsorships, and other digital services are final and non-refundable, except where legally required by law.
  • Physical Merchandise: We want you to be satisfied with your physical purchases. If you receive a physical item that is defective, damaged, or incorrect, you have a 30-day window from the date of delivery to contact us at info@hudpost.com for a replacement or refund. Please note that HUDPOST LLC is not responsible for standard transit delays caused by third-party shipping carriers once an item has been dispatched.

3. Missing Pet Flyer Service The following terms apply specifically to HudPost’s Missing Pet Flyer service:

  • Service Description: HudPost will create a custom missing pet flyer using the pet name, last seen location, contact number, and photo you submit. The flyer will be posted to the official HudPost Instagram Story and Facebook Story for a duration of 24 hours from the time of posting.
  • All Sales Final: Payment is non-refundable, except where required by law. Once you submit payment and the flyer has been posted to HudPost’s social channels, the transaction is final and complete.
  • Early Removal: If your pet is located before the 24-hour window ends, HudPost will remove the flyer from its stories at no additional cost upon request. Early removal does not entitle the customer to a refund, in full or in part.
  • Accuracy of Information: The customer is solely responsible for the accuracy of all information submitted. HudPost is not responsible for errors resulting from inaccurate or incomplete submissions.
  • No Guarantee of Outcome: HudPost does not guarantee that posting a flyer will result in the recovery of the pet. The service provides visibility through our audience, but we are not responsible for the outcome of any search.
  • Editorial Discretion: HudPost reserves the right to decline or remove any submission that violates its editorial standards, contains inappropriate content, or is determined to be fraudulent. In cases of declined submissions, HudPost will issue a full refund.

4. Voluntary Donations HudPost may accept voluntary financial contributions from readers to support our journalism. Please note that HUDPOST LLC is a for-profit entity, and therefore, contributions or donations are not tax-deductible. All donations are final and non-refundable.

5. Advertisers and Sponsored Content All advertising, sponsorships, and fundraiser promotions on HudPost.com are subject to our approval. Advertisers are solely responsible for ensuring their advertisements comply with all applicable state and federal laws. HUDPOST LLC assumes no liability for the products, services, or claims made within third-party advertisements or GoFundMe/Crowdfunding campaigns posted on our platforms.

6. Requests for Submissions and User-Generated Content We focus solely on news in Hudson County. By submitting content (text, photos, or videos) to HudPost, you grant HUDPOST LLC a non-exclusive, royalty-free, perpetual, and worldwide license to publish, modify, and distribute that content across our website and social media platforms. We cannot guarantee that reader submissions will be posted.

7. Defamation and Editorial Liability Shield As a news and media platform, HudPost.com publishes information sourced from the community, public records, and third parties. While we strive for accuracy, we do not warrant or guarantee the absolute correctness, completeness, or timeliness of any published content. HUDPOST LLC explicitly disclaims liability for any claims of defamation, reputational damage, or negligent publication arising from third-party submissions, user-generated comments, or good-faith journalistic reporting.

8. Article Removal and Correction Requests Due to the nature of news publishing and the historical public record, articles generally will not be removed from HudPost.com or associated social media accounts. However, we may update, correct, or in limited cases remove content at our sole discretion or as required by law (such as a valid court order). If you believe we have incorrectly reported information, please contact us so we may investigate and post a correction if necessary.

9. DMCA Copyright Policy HudPost respects the intellectual property of others. If you believe your copyrighted work has been infringed upon on our site, please contact us at info@hudpost.com with a detailed description of the copyrighted work, its location on our site, and your contact information, so we can investigate and remove it in accordance with the Digital Millennium Copyright Act (DMCA).

10. Intellectual Property HudPost.com, its original content, podcasts, logos, and branding are fully protected by appropriate United States and international copyright and intellectual property rights laws.

11. Disclaimer of Warranties and Limitation of Liability HudPost.com and its content are provided on an “as is” and “as available” basis. TO THE FULLEST EXTENT PERMITTED BY LAW, HUDPOST LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. HUDPOST LLC DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE. IN NO EVENT WILL HUDPOST LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS OR REPUTATIONAL DAMAGE) ARISING OUT OF THE USE OF OR INABILITY TO USE HUDPOST.COM.

12. Indemnification You agree to indemnify, defend, and hold harmless HUDPOST LLC, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the site, your user-generated submissions, your violation of these Terms, or your violation of any third-party rights.

13. Dispute Resolution: Binding Arbitration and Class Action Waiver PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms of Use, the breach thereof, or your use of HudPost.com shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Hudson County, New Jersey.

  • Class Action Waiver: YOU AND HUDPOST LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
  • Jury Trial Waiver: You waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury.
  • Limitation on Time to File Claims: Any cause of action or claim you may have arising out of or relating to these Terms of Use or the website must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

14. Governing Law, Venue, and Severability This Agreement is governed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. For any matters not subject to arbitration, legal proceedings shall be brought exclusively in the state or federal courts located in Hudson County, New Jersey. In any action to enforce these Terms, the prevailing party will be entitled to recover its reasonable attorneys’ fees and costs. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to This Agreement HUDPOST LLC reserves the right to modify these Terms of Use at any time by posting the updated terms on the site. Your continued use of the site after such changes constitutes your formal acceptance of the new Terms.
